Complying with legislative policy and industrial awards in the educational environment
Introduction
Industrial awards are the awards that are based on occupation in which the minimum employment standards are written that will be in addition to the National Employment Standards (NES). The industrial agreements will cover all the employees that are employed in the particular department. The industrial agreements are categorized into three sections: Public service, Teaching service and School and Maternal child health line nurses. In this report, we have discussed the Victorian Government Schools Agreement 2017 which will be commenced on 22 August 2017, with an expiry date of 30 April 2021. Business.gov.au. (2018). This agreement is applied to the employees who are in Government Teaching Service and are employed under the Part 2.4 of the Education and Training Reform Act 2006.
Minimum conditions of the agreement
Every certified agreement has minimum conditions for its application, and the Victorian Government Schools Agreement 2017 will be applied and binding upon the state of Victoria, which will cover all the persons that re-employed in the Victorian teaching Service under Part 2.4 of the Act, and is noted by the Fair Work Commission in terms of approval.
Preamble of the agreement
This agreement that is made between the State of Victoria and the employees and unions that are connected for the enhancement of interest of employment between the persons who are involved in the Victorian Government Schools, which will provide commitment in terms of providing best quality public education by increasing the standards of education and self-management of schools.
The agreement also monitors the overall impact of the agreement in terms of the unintended outcomes. This agreement will be amended as per the requirements of the Fair Work Act 2009.
This agreement also does not exclude the part of national Employment standards, as the standards are not applied to the employees, in terms of any claim, that is unfavorable for the entitlement of employee under the standards of National Employment. (Education.vic.gov.au. 2018) An instruction worker must be required to perform obligations reliable with their role(s) when required to go to amid school get-away periods, under sub statement (ii), unless the Employer and the representative generally concur. Objectives of the agreement

The agreement also provides the flexibility to schools, in terms of operation with the state framework, by delivering the improved educational content. The implementation in terms of improvement in the strategies will ultimately improve the methodologies of schools in the context of available resources for the achievement of desirable benefits. For the agreement, the need for the effective leaders is also the important context, in terms of principals and teachers. The agreement also focuses on the seven salary increment with the first increase in the commencement of first pay with effect from on or after 1 April 2017.
Responsibilities of the certified agreement
The agreement has to focus on certain responsibilities that will be focused as per the attainment of education by the children of Victoria, in terms of providing support to the employees in terms of fulfilment of responsibilities, in the context of professional work.
Commitments in terms of educational attainment
The commitment is required by employees in terms of fulfilment of responsibilities in the professional work. The agreement also focuses on the employees for increasing their knowledge in order to meet the diverse nature of student, who are going to attend the government schools. The agreement focus on the achievements of education of the Victorian Government Schools. It should be done by making an improvement in the educational context, by providing benefits to all students of the Victorian region. The agreement is also committed in terms of maximization of resources in an effective way that will ultimately provide benefits to the students of Victoria. The agreement will also focus on the needs of students in order to attain the high-quality process for the students of the Victorian region. (Sutherland, 2016) The focus is also on the development process of a student that leads to high performance, by making value addition in terms of quality learning. The work dimensions will be evaluated as per the roles and responsibilities of the employees that will provide support in the education, and if any changes will be incurred in the agreement will be done in consultation with the union of the agreement.
Grievance solution
The agreement will also address the grievance of the organizations that are under the Victorian Schools Agreement 2017. If the union of the school do not support the decision, under the sub clause (5) (c), the union must have the right to inform the principal regarding the problem in the support, by acting as the representative of employer, but not later than the five working days, which will include the reason for objection, and it will be provided to the principal, as the representative of the employer, by providing an opportunity for resolving the school matter. In addition to that, the notifications for subclause (5) (c) the long-term planning of grievance will be lodged later on in the sub-clause (a). Secondly, if the union at the school find out the matter to be unresolved then, in that case, the union of the school should report it to the Principal, as the representative of the Employer, and can pass on that matter to the union of the school within five working days.
Allocation of organizational duties
The agreement also discusses the responsibilities relating to the organizational duties. In addition to the teaching responsibilities, the teachers have to fulfil other duties also, according to the range of salary and the level of classification. These duties are termed as the organizational duties. With respect to the agreement, the principal as the representative of Employer has the responsibility for determining the duties of an organization, for the effective working of the school. If the organizational duty will attract the payment for any services, then, in that case, the special payment will be made to each teacher as per the salary range. Once the teaching staff will be provided with the organizational duties, in that case, the principal, as the representative of employer, will identify the most eligible candidate for the organizational duty, on the basis of merit-based selection process, will take into account the requirements of the organizational duty as per the qualifications and experience of the candidate.
